By visiting this site, contacting us or using any of our online tools, you accept these terms. If you disagree with any of them, do not use the site.

2. What we offer

  • Websites: design and development for businesses.
  • NegocIA: an AI agent, named Ada, that answers, schedules and follows up with customers on WhatsApp.
  • Custom AI automations: workflows that connect your business tools.
  • Social media content and presence: planning, production and publishing of content.

Scope, price, timelines and obligations of each hired service are set in the proposal or contract we sign with you. This site is not a binding offer: a WhatsApp conversation or a quote creates no obligation until both parties accept in writing.

3. How you may use the site

You may browse the site, download its content for personal use and contact us. You may not:

  • use the site for anything unlawful or to harm others;
  • try to access non-public areas, or test the site's security without written permission;
  • copy the entire site or pass it off as another;
  • submit content that is not yours, that contains malware, or that includes third parties' personal data without their permission.

4. Our social media publishing tool

We operate an internal tool, called Byte and Brand Social, to plan, produce, schedule and publish content on Instagram, Facebook and TikTok. We use it on Byte and Brand's own accounts and, if you authorize it in writing, on your business's accounts.

How authorization works

  • The connection uses each platform's official sign-in (OAuth). We never ask for or store your password.
  • We only request the permissions needed to publish and to read the metrics of the posts we publish.
  • We only publish content that you or an account owner approved. On client accounts the system publishes nothing without that approval.
  • You can revoke access at any time: from the platform's security settings or by writing to us. Once revoked, we stop publishing and delete the stored access.

What data we use and what we do not do

  • We use platform data only to publish your approved content and measure its performance.
  • We do not sell or share that data, and we do not use it for our own or third-party advertising.
  • We do not download other accounts' follower lists or message your followers unsolicited.
  • Credentials are stored encrypted and read only by the system that publishes, not by people.

We also comply with each platform's terms and policies. If a platform limits, rejects or removes a post, or suspends an account, that decision is theirs; we will notify you immediately and look for the best alternative, without guaranteeing the outcome.

AI-generated content

When an image, video, voice or character is generated with artificial intelligence, we say so in the post and use the AI labels each platform provides.

5. Intellectual property

The texts, designs, code, trademarks and other elements of this site belong to Byte and Brand or its licensors. Your brand, photos and texts remain yours: you authorize us to use them only to provide the service. What is delivered at the end of each project, and under which license, is set by the contract.

6. Artificial intelligence services

Artificial intelligence can be wrong. That is why we set limits, review the work and let a person decide what matters. We do not guarantee that an answer, image or text generated with AI is always correct, and you remain responsible for your business decisions. Ada does not give medical, legal or financial advice.

7. Warranties and liability

We do not promise specific sales, follower or ranking results: they depend on many factors we do not control, such as the market, the platforms and your own business. The site is provided as is and may be interrupted.

To the extent permitted by law, our liability is limited to the amount actually paid for the service that gave rise to the claim, and excludes indirect damages and lost profits. This does not limit rights that the law does not allow to be limited.

8. Third-party services and links

We use third-party services (for example WhatsApp, Instagram, Facebook, TikTok, cloud and AI providers). Each has its own terms and privacy notice. We do not control those services and are not responsible for their changes.

9. Privacy

How we process your personal data is explained in the Privacy notice. To exercise your rights of access, rectification, cancellation and objection, write to zunigama@byteandbrand.org.

10. Changes to these terms

We may update these terms. We will publish the new version on this page with its date. If a change affects a service you already hired, we will notify you before it applies.

11. Buying a website online: payment, cancellation and refunds

This section applies when you buy a website package (Launch, Essential, Motion or Immersive) online, or the quote and customization session. Signature isn't sold online: it's quoted. If we also sign a services contract with you, that contract supplements this section; if they differ, the contract governs.

What you buy and what you pay

  • You buy the package you chose, with what its card says on the purchase page at the time you pay. Prices are in Mexican pesos and include VAT; we issue CFDI 4.0 invoices.
  • The one-time payment covers building and delivering your site. You pay no card surcharge: the payment processor's fee is on us.
  • Payment is processed by Stripe. We never see or store your card details.
  • Your purchase is confirmed once the payment clears and you send us the details form. We can't start without your details and access.

The monthly fee

  • The monthly fee is paid month to month, with no minimum term. To cancel it, you let Adrián know and he confirms from when it takes effect.
  • The monthly fee includes: hosting with a security certificate, sized for the traffic of a local business; email on your domain (Launch 1 mailbox, Essential 3, Motion 5 and Immersive 10); the annual renewal of your domain, while you keep paying the monthly fee; and automatic weekly backups, keeping the latest 4.
  • It also includes minor changes each month (text, prices, hours, images and links): Launch 2, Essential 4, Motion 6 and Immersive 8. They don't roll over. A new section or a redesign is quoted separately.
  • And a monthly report in Spanish, by email, within the first 5 days of the month (visits, WhatsApp contacts by button or section, where people came from and most-viewed pages, with one or two recommendations) and support by WhatsApp or email, Monday to Friday, 9:00 a.m. to 6:00 p.m.: if the site fails, a reply within 1 business day; for changes, within 2 business days.
  • The first charge happens one month after your payment, then every month automatically to the same card. If a charge doesn't go through, we tell you and you can update your payment before we suspend the service.
  • Monthly fees already charged are not refunded.
  • Even if you cancel or stop paying, your domain and your site are yours: we hand over the complete files so you can take them wherever you want. If you stop paying the monthly fee, the annual renewal of the domain is at your expense; the domain is always in your name.

Your implementation call

After paying, you book a one-hour video call on our calendar (Monday to Friday, 9:00 a.m. to 6:00 p.m. Mexico City time). You can reschedule at no cost with at least 24 hours' notice. The Essential package is delivered in 5 business days, counted from when you give us your information on the implementation call. Your package's delivery days count from when you send us the information and access we ask for, and pause while we wait for your reply.

Cancelling and refunding a package

  • Before your implementation call: if you cancel, we refund 100% of the one-time payment.
  • Work has started, before we deliver the first version: we refund 50% of the one-time payment. The other 50% covers the start-up work already done.
  • After we deliver the first version: the one-time payment is no longer refundable, because the work is done. You still have your package's rounds of changes.
  • If we fall short: if anything you contracted isn't delivered, we fix it within fifteen calendar days of your written notice. If we don't, you can terminate and we refund the portion corresponding to what wasn't delivered.
  • How refunds are paid: to the same method you paid with, within ten business days after we accept your request. When the relationship ends for any reason, we hand over your files and access within ten business days at most.

Quote and customization session ($1,000 MXN)

  • A video session where we review your case and tell you which package fits and what we'd adjust. It costs $1,000 MXN, VAT included.
  • If you sign on within 30 days after your session, that $1,000 is credited toward your package. We email you a single-use discount code to apply at checkout.
  • It isn't refundable unless we cancel or can't attend to you, in which case we refund 100%. You can reschedule at no cost with at least 24 hours' notice.

How to request a cancellation or refund

Write to zunigama@byteandbrand.org or on WhatsApp at 55 7415 0288 with your name and the email you paid with. We reply within two business days at most.

Your consumer rights

Nothing above limits the rights the law grants you, for example before the Federal Consumer Protection Agency (PROFECO) when you are a consumer under the Federal Consumer Protection Law. If a rule in this section conflicts with a right the law doesn't allow to be limited, the law prevails.

12. Governing law and jurisdiction

These terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Mexico City, unless the law gives you the right to another jurisdiction.

13. Contact

Questions about these terms: zunigama@byteandbrand.org or WhatsApp +52 55 7415 0288.

This is a courtesy translation. The Spanish version governs. These terms are general in nature and do not replace the proposal or contract you sign with us. If anything is unclear, write to us before using the service.
